Agreement and eligibility
By using FoilBear, you agree to these terms and the Privacy Policy. You must be able to enter a binding agreement where you live. If you use FoilBear for an organization, you confirm that you may accept these terms for it.
Foiling and weather involve real risk
eFoiling can cause serious injury, drowning, equipment damage, or death. FoilBear does not control your board and cannot determine whether a ride is safe. Weather, water, tide, lightning, route, battery, and coaching information may be delayed, incomplete, estimated, or wrong.
- Check official forecasts, warnings, local rules, and actual conditions.
- Use appropriate safety gear and stay within your ability and equipment limits.
- Never rely on FoilBear as an emergency, navigation, medical, or rescue service.
- You remain responsible for every launch, route, maneuver, and equipment decision.
Accounts and acceptable use
Keep your account secure and provide accurate information. Do not misuse the service, attempt unauthorized access, interfere with other riders, upload unlawful or harmful material, scrape the service, or use FoilBear to violate another person's rights. We may suspend access needed to protect riders, the service, or the law.
Your content
You keep ownership of ride notes, routes, and other content you create. You grant Pepstar LLC a limited license to host, process, reproduce, and display that content only as needed to operate and improve FoilBear and provide features you request. You are responsible for content you choose to share through a public link.
Affiliate links
Some gear links may be affiliate links. Pepstar LLC or a launch partner may earn a commission if you make a qualifying purchase, without changing your price. A recommendation is informational; verify fit, compatibility, warranty, and safety with the manufacturer or seller.
FoilBear ownership
The FoilBear name, software, design, forecasts, analysis systems, and related materials belong to Pepstar LLC or its licensors. These terms give you a personal, limited, revocable, non-transferable right to use the service. They do not transfer ownership of FoilBear intellectual property.
Service changes and termination
We may improve, add, remove, or discontinue features. You may stop using FoilBear at any time, sign out, or delete your FoilBear account in the app. Deleting FoilBear does not delete a shared PepStar sign-in identity or an account you use with another PepStar service. Terms that should survive termination, including ownership, disclaimers, and limits of liability, continue to apply.
Disclaimers and liability
To the maximum extent permitted by law, FoilBear is provided “as is” and “as available,” without warranties of accuracy, availability, fitness for a particular purpose, or non-infringement. Pepstar LLC is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, profits, equipment, or riding opportunities arising from use of the service. Nothing here excludes a right or liability that applicable law does not allow us to exclude.
Florida law and contact
